Welcome to Onwinds. These Terms govern your access to and use of the Onwinds platform, software, and services (collectively, “Onwinds”). By using Onwinds, you agree to these Terms. If you do not agree, you must not use Onwinds.

1. Provided “As Is”

Onwinds is provided “as is” and “as available” without warranties of any kind. We make no guarantees regarding availability, performance, accuracy, reliability, or fitness for a particular purpose.

2. No Liability

To the maximum extent permitted by law, Onwinds and its legal owner disclaim all liability in every jurisdiction. This includes, without limitation:

• Direct, indirect, incidental, consequential, or punitive damages.
• Loss of profits, data, revenue, goodwill, or business opportunities.
• Downtime, outages, delays, or service interruptions.
• Data loss, corruption, breaches, or compliance failures.
• Issues arising from integrations, third-party services, or reliance on outputs.

If exclusion of liability is not permitted by law, our aggregate liability shall not exceed USD 1.

3. No Service Levels or Commitments

Unless covered by a signed enterprise contract, Onwinds provides:

• No uptime guarantees or SLAs.
• No support or maintenance obligations.
• No promise of backward compatibility for APIs, formats, or features.
• Features and functionality may change or be removed without notice.

4. Use at Your Own Risk

You are solely responsible for your use of Onwinds, including compliance with all laws and regulations, as well as safeguarding your systems and data.

5. No Advice

Onwinds does not provide legal, financial, compliance, or tax advice. Any information or outputs are strictly technical and informational.

6. Enterprise Contracts

Any warranties, service levels, or liability apply only where explicitly agreed in a signed enterprise contract with Onwinds’ legal owner. Without such a contract, these Terms apply in full and Onwinds assumes no liability.

7. Termination

We may suspend or terminate your access at any time without notice, for any reason.

8. Governing Law and Severability

These Terms are intended to exclude liability in all jurisdictions to the fullest extent permitted by law. If any provision is found unenforceable, the remainder shall remain in full force and effect.

9. Entire Agreement

These Terms represent the entire agreement governing your use of Onwinds, unless superseded by a signed enterprise contract.
